TLDR

iubenda clarifies that moving tracking infrastructure server-side doesn't exempt marketers from GDPR and ePrivacy consent requirements.

iubenda published a guide on October 23 clarifying that shifting tracking tags to server-side infrastructure does not alter legal obligations under GDPR and ePrivacy law to obtain user consent before processing personal data. The location of data collection—client-side or server-side—doesn't change the requirement to ask permission first, the company explains.
